BUSINESS VERIFICATION

For your protection, Muscle Foods USA verifies all new businesses before releasing wholesale price information. We request photocopies of your sales tax license,vendor’s certificate or resale certificate to be sent in for review. You will be notified upon approval.

AFTER HOURS ORDERING

If you wish to place an order outside of normal business hours please log on to shop.musclefoodsusa.com. Your rep can provide you with login credentials. Here you can use the Quick Order form to enter by item or browse our entire catalog. You will see real time availability and your discounted pricing. There is a $300 minimum for web orders. Any orders under $300, will incur a flat rate shipping amount of $25.

ORDERING INFORMATION

Our fast, courteous service makes ordering at Muscle Foods USA easier than anywhere else! When you call in your order, please have your assigned customer number and product code numbers ready for our customer service representatives. This will expedite your order and ensure accuracy.

SHIPPING CHARGES

Muscle Foods USA provides Free Shipping on all orders over $300 in the continental United States using the carrier of our choice. Any orders under $300, will incur a flat rate shipping amount of $25. Excludes orders to AK, HI, PR, US Virgin Islands and international orders. If you choose an alternate carrier Muscle Foods USA will charge the difference to your invoice. Large and/or heavy order (such as Ready-to-Drink products) may be shipped using LTL Common Carrier. In this case, if you require inside delivery Muscle Foods USA will pass along this charge on your invoice.

ADD ONS

Order processing, in most cases, is complete within ½ hour after being called in. We will add to your current order whenever possible. However, if we are unable to do so, your additions will be treated as a new order, subject to appropriate shipping charges.

SPECIAL ORDERS

Whenever possible we will obtain an item for you that is not a stocked item. Prepayment is required on all special orders. We may also require that you purchase a case quantity. Delivery times may vary. Ask your customer service representative for more details.

PRODUCT AVAILABILITY

We make every effort to have all items in stock at all times. However, due to problems in obtaining raw material or market fluctuations, some items may be unavailable for a period of time.

OUT OF STOCK/BACKORDERS

Muscle Foods USA does not automatically back order out-of-stock items. If out-of-stock items total $50.00 per stock item, you may request a backorder. For a paid backorder, you will be charged for the item(s) and they will be shipped when available. Prepaid backorders will be shipped in complete quantities. An unpaid backorder will be treated as a new order subject to appropriate shipping charges. You will be notified when the item(s) is available. We may not hold back orders on sale items.

PRICE POLICY

Retail prices are suggested by the product manufacturer. In the event of a price increase, we will try to give advance notice when possible. However, due to the short notice we are given, it is not always possible to give written notice. We are not responsible for typographical errors.

TERMS AND CONDITIONS OF SALES

All sales are FOB Muscle Foods USA warehouse. Terms and conditions set forth throughout this document govern the contract for sale between seller and buyer. Seller may from time to time alter or expand on terms of conditions.

PAYMENT TERMS

All first orders are shipped prepaid. We accept certified check, money order or credit card with a verifiable address.
Business checks may be accepted as a COD payment with management approval or after your initial order.
Muscle Foods USA accepts all major credit cards for any order, without a service charge. Credit card holders must be the Corporation, Business Owner or Manager. Business owners are responsible for any transactions on their account. You will be charged a $9.00 COD tag fee for UPS or FedEx COD orders.
For your convenience, electronic payment is available. Ask your sales representative for details.
We may extend credit terms to those who qualify. We ask that you complete a credit application and a net term credit card authorization. All net term customers must keep a valid credit card on file. Outstanding balances will accrue interest at a rate of 1.5% per month. You will also be responsible for any and all collection costs.

RETURNED CHECK POLICY

Any check returned by the bank due to nonpayment is automatically rede- posited. At this time your account will be charged a $20.00 bank fee. If the check is returned a 2nd time, your account will be put on HOLD. Your ac- count terms will remain certified check, money order or prepaid with a credit card. If you are notified by your bank that a check will be returned, please call David Orsheski, our Accounts Receivable Manager immediately at (570) 543-4819 or send an email to davido@musclefoodsusa.com

ACCOUNTS RECEIVABLE/ COLLECTIONS

We provide you with both invoices and account statements. If difficulties arise, please contact us immediately. We will always try to work with you but if you do not communicate with us our accounting staff will make 3 attempts to call you, followed by a written notice that your account is in danger of going into collections. If you do not contact after the written notice your account will be turned over to collections.

SHIPPING INFORMATION TERMS

Shipping will be via UPS Ground Service or other similar service including FedEx. Next Day, Second Day and Three Day Service is available but must be paid in full by the customer. Shipping charges are based on your UPS or FedEx zone. When your order qualifies for free shipping, Muscle Foods USA reserves the right to determine the best method for shipping, including ground packages and orders that qualify for a common carrier. In the event that you want a specific carrier, any excess shipping charges will be charged on your invoice.

PALLET SHIPMENT

Muscle Foods USA will determine if your order qualifies for common carrier shipment. ALL pallet deliveries must be accepted on the first delivery attempt. Any charges for refused or delayed pallets will be charged to customer. Customer will be charged if Inside Delivery is required or requested. CHECK FOR VISIBLE DAMAGE(S) AND NOTE DAMAGE(S) ON THE BILL OF LADING. Damaged carton(s) can be refused. For all damages, both visible and hidden, keep the damaged product(s) in its original box with the packing material and notify us within 24 hours. You may be required to submit a Certificate of Damage and a picture of damage(s). Muscle Foods USA will arrange for a pick up of the damaged item(s). We will issue credit to your account after approval.THESE STEPS MUST BE FOLLOWED IN ORDER TO RECEIVE PROPER CREDIT!

DAMAGES

In the event of damages please do the following:

GROUND SHIPMENTS

For a visible damage refuse delivery of the damaged carton(s) or accept the carton(s) and notify us within 24 hours. For all damages, both visible and hidden, keep the damaged product(s) in its original box with the packing material and notify us within 24 hours. You will be required to submit a Certificate of Damage and picture of damage(s). Muscle Foods USA will arrange for a pickup of the damaged item(s). We will issue credit to your account within 3 business days after approval.
THESE STEPS MUST BE FOLLOWED IN ORDER TO RECEIVE PROPER CREDIT!

SHORTAGES/MIS-SHIPMENTS

Because of our double check packing system we have a minimal amount
of errors. On the rare occasion that an error occurs, please thoroughly inspect the box a second time for the product(s). If the product(s) still cannot be found or if you received the incorrect item, contact our office within 24 hours of receipt of the shipment. If your order was on a pallet, before signing the bill of lading, verify carton count received with carton count noted on bill of lading and note the shortage on the bill of lading. THESE STEPS MUST BE FOLLOWED IN ORDER TO RECEIVE PROPER CREDIT!

REFUSED ORDERS

Please be prepared to receive our shipment when it arrives. If an order is returned by UPS, FedEx or common carrier for any reason, the additional shipping charges and a $20.00 service fee will be charged to your account. If you return 2 orders, your account may revert to PREPAID ONLY without additional notice.

RETURNS

Returns must be received at Muscle Foods USA within 30 days of purchase. We ask that you first call us for a RETURN AUTHORIZATION NUMBER.
Shipping charges must be paid by you (COD returns). Please insure your package. A 20% restocking fee will be charged to all returns. The merchandise must be unopened and not marked in any manner. Closeout and discontinued items may not be returned.

PRODUCT RETURNS FOR ADVERSE EFFECTS ON CONSUMER

As a distributor of dietary supplements Muscle Foods USA is required to report information about serious adverse effects associated with the use of these supplements to the Food and Drug Administration (FDA). A Serious Adverse Effect is one that results in death, life threatening experience, inpatient hospitalization, persistent incapacity, congenital anomaly or medical intervention to prevent the above. This requirement is detailed in Dietary Supplement and Nonprescription Drug Consumer Protection Act, enacted on December 22, 2006.

If you have a product that causes a serious adverse effect on a consumer we will request the necessary information to complete an FDA Form 3500A. Report submission in not an admission of fault.
